What is a Nonpayment Eviction?

A nonpayment eviction is the legal process NYC landlords use to recover possession of a rental unit when a tenant fails to pay rent. Unlike other eviction types, nonpayment cases focus solely on unpaid rent and allow tenants to cure by paying what they owe.

The process begins with serving a Rent Demand (14-day notice for month-to-month tenants, or notice period specified in the lease). If the tenant doesn't pay or cure within this period, you can file a Nonpayment Petition with NYC Housing Court.

Why Professional Preparation Matters

NYC Housing Court has strict filing requirements, and a single error can delay your case by weeks or result in dismissal.

Common Filing Errors:

  • Incorrect rent calculation or ledger format
  • Missing or improper service affidavits
  • Failure to attach required notices
  • Incomplete tenant information
  • Non-compliant Good Cause Eviction disclosures

Consequences:

  • Case dismissed or adjourned indefinitely
  • Lost rent during delays (months)
  • Additional legal fees to correct errors
  • Tenant gains leverage in negotiations
  • Court sanctions or attorney fee awards

Good Cause Eviction Law Compliance (2024)

New statewide requirements for nonpayment cases

As of 2024, New York's Good Cause Eviction law applies to most rental units outside NYC's rent-stabilized housing (and to NYC stabilized units under separate local rules). Even in nonpayment cases, landlords must now:

  • Provide detailed notice of all rent charges and increases
  • Justify any rent increase above 3% or 1.5x CPI (whichever is higher)
  • Include specific disclosures in the petition about rent history
  • Comply with strict service and notice timing requirements

Non-compliance can result in case dismissal and expose you to tenant counterclaims for attorney fees and damages.
