Filing Requirements & Fees

Required Documents:

  • Original petition (nonpayment or holdover) with all exhibits
  • Service affidavits (rent demand, notice to cure, termination notice)
  • Rent ledger or supporting documentation
  • Index number request form
  • RJI (Request for Judicial Intervention) if required

Court Filing Fees (2024):

  • Nonpayment Petition: $45 filing fee + $35 index fee = $80 total
  • Holdover Petition: $45 filing fee + $35 index fee = $80 total
  • RJI (if required): $95 additional

*Court fees are separate from our service fee and paid directly to court

After Filing: What Happens Next?

1. Serve the Tenant

You must serve tenant with summons and petition within 72 hours of filing. Use process server or marshal.

2. File Affidavit of Service

After service, file proof of service with court before first court date.

3. Attend Court Appearance

Appear on scheduled court date. Tenant may have attorney (Right to Counsel). Be prepared to negotiate or proceed to trial.

4. Obtain Judgment (If You Prevail)

If case resolves in your favor, obtain judgment and warrant of eviction. Marshal executes warrant.
